These Terms of Service (“Terms”) apply to the website and online store operated by Simply 3D Prints at simply3dprints.com and to purchases made through our store.

By accessing our website or purchasing a product from us, you agree to these Terms. Nothing in these Terms limits any mandatory rights you may have as a consumer under applicable law.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services.

2. Products

We sell physical products as well as digital products, including downloadable STL files.

We make reasonable efforts to ensure that product descriptions, photographs, compatibility information, specifications and prices are accurate.

Because many of our physical products are manufactured using 3D-printing processes, minor variations in surface texture, layer appearance or finish may occur. Such normal characteristics of the manufacturing process do not in themselves constitute a defect.

Colours displayed on a screen may differ slightly from the actual product.

We may modify, improve or discontinue products and may update product specifications where appropriate.

3. Compatibility

Where a product is designed for use with a particular device, launch monitor, simulator or other third-party product, compatibility information will be stated on the relevant product page.

Customers are responsible for selecting the correct product or variant for their equipment based on the information provided.

References to third-party brands and products are used to describe compatibility unless explicitly stated otherwise. Simply 3D Prints is not affiliated with or endorsed by those manufacturers merely because their product names or trademarks are referenced.

4. Orders

Placing an order constitutes an offer to purchase the selected products.

We reserve the right to refuse or cancel an order where reasonably necessary, for example because of an obvious pricing error, suspected fraud, incorrect product information, inability to fulfil the order or restrictions affecting delivery.

If we cancel an order after payment has been received, we will refund the relevant amount.

You are responsible for providing complete and accurate billing, delivery and contact information.

5. Prices, VAT and payment

Prices are displayed in the currency and with the tax treatment applicable to the relevant store or market where possible.

Applicable VAT, taxes, shipping costs, duties or other charges will be shown or calculated during checkout where supported.

For international orders, import duties, taxes, customs charges or handling fees may apply depending on the destination and shipping arrangement. Where these charges are not collected by us at checkout, they may be charged to the recipient by customs authorities or the carrier.

Payment is processed using the payment methods offered during checkout.

6. Shipping and delivery

Physical products are shipped from the Netherlands.

Available shipping methods, estimated delivery information and applicable shipping charges are displayed during checkout where available.

Delivery estimates are estimates and are not guaranteed unless expressly stated otherwise.

International shipments may be delayed by customs procedures or circumstances outside our reasonable control.

Customers are responsible for providing a correct and complete delivery address.

7. Returns and refunds

Returns, withdrawals, refunds, damaged products and other return-related matters are governed by our Refund Policy.

Our voluntary return arrangements do not restrict any mandatory consumer rights that apply under applicable law.

For consumers in the European Union, statutory rights including the right of withdrawal apply where required by law and subject to applicable exceptions.

8. Digital products and STL files

Certain products sold by Simply 3D Prints are digital downloads, including STL files intended for 3D printing.

A digital product does not include a physical printed product unless this is expressly stated on the product page.

Customers are responsible for ensuring that they have suitable equipment, software, materials and knowledge to use and print the purchased files.

Results from 3D printing can vary depending on printer calibration, slicer settings, filament, material, print orientation and other manufacturing conditions. We therefore cannot guarantee identical printing results across different equipment and setups.

Statutory rights relating to digital content remain unaffected.

Where permitted by applicable law, the statutory right of withdrawal for digital content may end once delivery of the digital content begins after the customer has expressly consented to immediate delivery and acknowledged the resulting loss of the right of withdrawal.

9. License for digital files

Unless explicitly stated otherwise, digital files purchased from Simply 3D Prints are supplied under a Personal Use License.

The purchase grants you a limited, non-exclusive and non-transferable right to use the purchased digital files for personal use.

You may print physical items from the files for your own personal use.

You may not, without prior written permission from Simply 3D Prints:

sell or commercially distribute the digital files;
share, upload, copy or redistribute the digital files;
sell or commercially distribute modified versions of the files;
sell physical products manufactured from the files;
use the files as part of a commercial manufacturing or print service; or
otherwise use the files commercially.

Purchasing a digital file does not transfer ownership of the underlying design or intellectual property.

10. Intellectual property

Unless otherwise stated, the designs, digital files, product photographs, graphics, text, branding and other original content created by Simply 3D Prints are owned by or licensed to Simply 3D Prints and are protected by applicable intellectual-property laws.

You may not reproduce, distribute, sell or commercially exploit our protected content or designs without permission, except where permitted by law or by a specific license supplied with a product.

Third-party trademarks and product names remain the property of their respective owners.

11. Product reviews and user content

If you submit a product review, photograph or other content for publication on our website, you confirm that you have the right to submit that content.

You grant us permission to display and use that content in connection with our store, products and customer communications, subject to applicable law.

We may remove content that is unlawful, misleading, abusive, infringes third-party rights or is otherwise inappropriate for our Services.

12. Acceptable use

You may not use our website or Services:

for unlawful or fraudulent purposes;
to infringe intellectual-property or other rights;
to introduce malicious software or interfere with website security;
to collect information about other users without authorisation; or
in any manner that could damage or disrupt our website or Services.

13. Third-party services and links

Our website may use or provide access to services operated by third parties, including payment, shipping, review and ecommerce services.

Third-party websites and services may be subject to their own terms and policies.

We are not responsible for third-party websites or services except to the extent responsibility cannot legally be excluded.

14. Legal guarantees and liability

Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited, including mandatory consumer rights and statutory guarantees.

Products must conform to the agreement and consumers retain their statutory rights in relation to defective or non-conforming products.

To the extent permitted by applicable law, Simply 3D Prints is not liable for indirect or consequential losses that were not reasonably foreseeable when the agreement was entered into.

We are not responsible for loss or damage resulting from misuse of a product, use contrary to supplied instructions, unauthorised modification or use for a purpose for which the product was not reasonably intended.

15. Privacy

Our collection and processing of personal information is described in our Privacy Policy.

16. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to our products, Services, business practices or applicable law.

The version applicable to a purchase is the version in effect when the relevant agreement is entered into, unless applicable law provides otherwise.

The current version will be made available on our website.

17. Governing law

These Terms and agreements with Simply 3D Prints are governed by the laws of the Netherlands.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protection provided by the law that would otherwise apply to you.

Any dispute will be handled by the competent court in accordance with applicable law.
